1. GENERAL INFORMATIONS

www.fuyor.ro website is the property of GOLDEN VELVET SRL as retailer.

The following terms and conditions will apply to all the sales from seller to buyer via online store. Before ordering products from this website online or by email, please read these terms and conditions which detail all the aspects about rights and obligations, about placing an order, about delivery and return and all their costs.

The photos published on the website are real, but sometimes the shade of the colors of the products may be a little different due to the photo shooting or the settings of your monitor. This is the reason why the orders must be confirmed before the delivery.

Seller – GOLDEN VELVET, trade name GOLDEN VELVET SRL, headquarters: Bucharest, no21-23, Loviștei Street, attic, apartment 21, rom, sector 3, registered to the Trade Register Office at no J40/9573/,tax code 41422789

Buyer – individual/legal person or other legal entity placing an order

User – any individual registered on website, which by creating an account has agreed to the terms and considitions of the site.

Acount – the section of the website that contains an email address and a password allowing the buyer to place orders and contains informations about Client/Buyer and his archived history (order, invoices, warranties, products, etc.). The user is responsible and will make sure that all the informations provided when opening an account are accurate, complete and up to date.

Favorites – is a section of the account which allows the Buyer/User to generate a list of products that would eventually be the subject of purchase, tracking the products by notifications sent by the seller.

The order – a form of communications between the seller and the buyer, an electronic document sent by website or email, document that shows the buyer’s intention to purchase a product.

Products and Services – any product or service listed on the website, ordered products included, that are about to be provided (delivered) by the seller  to the buyer according to the agreement.

Commercial agreement – (according to GEO 34/2014) – means any agreement between the trader and the customer without them being physically present, using one or more distance communication devices, until and even up to the moment of agreement (confirmation of acceptance of the trader) when the trader commits to transfer the property of some products to the customer and the customer commits to pay their price. In a better understanding, distance commercial agreement means any purchase from this website.

2. HOW DO I ORDER?

To order on our site, press “add to cart” button and then you can check the selected items, having the option to continue or to complete the purchase.

You can also order your favorite items by email ( office@fuyor.ro). Orders will be checked by the company’s representatives and then you will receive a confirmation.

3. PRICE AND STOCK

The prices and the stock are periodically updated. As payment method we accept credit card, paypal or bank transfer.

The price, the payment method and the payment term are mentioned in the order. The seller will issue an invoice for all the products and services delivered to the buyer, and the buyer has the obligation to provide all the necessary informations in order for that invoice to be issued, in accordance to the laws in force.

Client/user/buyer’s credit card data won’t be accessible and won’t be stored by GOLDEN VELVET or by the payment processor on the website but only by the authorized institutions.

The client/user/buyer will be informed about the identity of this institution prior to the data entry.

4. DELIVERY CONDITIONS

Manufacturing and delivery term for our products is currently about 3 to 10 days since confirmation, depending on the shipping agency, except in cases of emergency like weather conditions, road blocks or car accident, or other special situations like a change in the work hours of the shipping agency or delays caused by the “Black Friday” type of massive sales. In these situations, the delivery term may be extended but no more than30 days, according to GEO 34/2014, and we will inform you about any term extention that may occur.

The cost for a delivery is calculated according the distance to your location. You’ll be informed about the exact shipping cost before your order confirmation.

If the package can’t be delivered (because there is no one home, the address is not correct , etc.) the courier will call you. The international shipping cost is calculated depending on the country where your order was placed.

5. THE PRODUCT RETURN

You have a 15 days withdrawal from the contract period, without any justifications and no additional costs, except the product return costs. The product return right is granted only if within 15 days period of time, starting the moment you got into the possession of the item, we are informed about your decision to return the product. (not used and in its original package or else its value will decrease)

Withdrawal right

Before the expiry of the withdrawal period (15 days) the consumer shall inform the trader of his decision to withdraw from the contract on email: office@fuyor.ro   specifying the purchased items.

If you withdraw, we will refund any payment that you’ve made, with no unjustified delay and in no longer than 15 days period of time starting the moment we are being informed about your withdrawal decision. We will refund using the same payment method as in the initial transaction unless you agreed to another method of payment; in any case, no commission will be perceived for this refund. We have the legal possibility to postpone the refund until the purchased items are back in our possession.

The product return costs (shipping fee) is your legal responsibility and will be paid by you.

You have the possibility to easily check and determinate the functionality of the product without damaging the item or the package. The item is wrapped in a plastic package together with a gift (a bracelet). The return product with mechanical, physical or visual damaged package and missing gift may decrease in value up to 30% of its initial value, according to the law in force.

Withdrawal exceptions

The items manufactured according to the costumer’s specification and customized are exceptions and they cannot  be returned.

The risk transfer

The delivery of the products to you is our responsibility.

In our company’s shipping agreement, the risk of losing or  damaging the products is only transferred to you the moment these products get into our possession.

In the product return situation, the risk is transferred to you in the case of agreement withdrawal, in the moment of delivering the items to the transporter, if the transporter was assigned by you to transport the products, and this option was not offered by our company, without any prejudice to the rights you have over the transporter.

6. MAJOR FORCE

Neither party shall be liable for non-contractual obligations, if such default is due to a major force event.

Major force events are unpredictable, out of any party’s control and cannot be avoided.

7. WARRANTY

All the items sold on this website are new, they come along with all the tax papers and warranty requirements.

The warranty is in acoordance to the law 449/2003, updated (r) and GO 21/1992, (r2) and is valid for individuals.

Our company, as retailer, ensures the warranty.

The average use and warranty period is 30 days since the purchase.

There is a 15 days time limit for rectification of deficiencies since the default products come into our possession .     

Warranty shall be provided once deficiencies are found.

For that, you have to send back to the store the item, together with the receipt or the invoice proving the purchase. Name of the item, price, date of purchase are informations found on the tax papers and they represent important data that our company needs to solve any further complaints.

Ways of ensuring the warranty are: repairment, replacement and refunding in this exact order.

In order to restore the item to its proper state first the necessary repairments are made, then the replacement and the last is the refund, if that is not disproportional and all the other measures were not efficient or impossible.

In order to benefit the warranty (to be covered by the warranty), a warranty certificate must be provided together with the invoice (copy of the invoice) or the receipt of the purchse

The warranty is granted only for the defaults occurred after a proper handling and usage of the item.

Warranty becomes invalid if the item hasn’t been used according to the instructions of the label (icons and symbols), if the inner label was cut, if the mechanical, thermal or plastic deteriorations has occurred, if the information data of the warranty certificate was modified, not showing a receipt or an invoice when required.

We strongly recommend that you check the icons and symbols of the inner label and follow the instructions!

The content, the instructions and the washing, bleaching, drying, spin cycle and dry-cleaning instruction icons are found on the inner label of the item.

These instructions are specific for your product and are mandatory. The clothes shall be washed or cleaned according to the instructions of the inner label. Our company declines any responsibility for a third party’s damage such as dry-cleaners.

SPECIAL TERMS

We are making great efforts for a correct and real image (photo of the item) display, but it may differ the original item according to each monitor’s calibration and resolution.

Promotions are not to be accumulated with other promotions or discounts.
